BOARD OF HEALTH MEETING
October 14, 2014

Board Member Alba Gouldthorpe opened the meeting at 6:00 p.m. Present was board member Elaine Byrne. Also present, Health Agent Deborah Rogers, and Health Inspector Virginia Bacon. Chairman Steve Fram was absent.
2 FOREST STREET – Scott Cameron from the Morin-Cameron Group, requested the following variances: 1.) Distance from soil absorption system to property line required 10’ to 5.1’ to street. 2.) Distance from septic tank to property line required 10’ to 6’. 3.) Distance from soil absorption system to foundation required 20’ to 5’. 4.) Distance from tank to foundation required 10’ to 5’. Presby Enviro-septic waste water treatment system: Reduce the depth to groundwater required by 2’ as allowed in the remedial use approval issued by the D.E.P. issuance date March 19, 2013. It was moved by Alba Gouldthorpe to approve the variances as submitted; it was seconded by Elaine Byrne and voted unanimously.
21 HAY STREET – Stephen Sawyer from S.B.S. Engineering, requested the following variances: 1.) Variance is sought from the requirement of a percolation test in the proposed soil absorption system area, soil lab analysis used to determine effluent loading rate. 50% reduction of the soil absorption system as allowed by DEP policy with use of I/A treatment device. 2.) Variance is sought from the requirement of a removal of unsuitable material from sides of soil absorption system. 2.5 is proposed to be removed. It was moved by Elaine Byrne to approve the variances as written; it was seconded by Alba Gouldthorpe and voted unanimously.
TENDERCROP FARM –Mr. Card from plumbers Lane and Mr. Kuter from the company that spreads the lime for Tendercrop Farm attended the meeting. Katherine O’Brien from the Agricultural Committee also attended. The meeting was to arbitrate a solution between the spreading of lime on the Tendercrop Farm fields in a way that would not affect Mr. Card’s or his family’s health. All attendees brainstormed a solution that would allow Tendercrop farm to still spread the lime in the fields without causing a threat to any of the neighbors. There is one more field that needs to be still spread with lime for this year. Mr. Kuter suggests spreading in cooler weather to help minimize the lime odor. The board would like Mr. Kuter to contact Mr. Card prior to any additional future spreading of lime on the remaining
field. All parties agreed to try to work together so further spreading would not cause any additional nuisance to Mr. Card.
TOWNHALL SEPTIC – The town hall septic system is in failure with limited space to replace. The Board of Selectmen would like to hook-up to Newburyport Sewer and requested a letter from the BOH. The letter would support the request to hook-up to the Newburyport Sewer because of the limited parking space that would be lost if the septic system was to be replaced on the town hall property.
CDM – Back in January, CDM was going to apply to MA DEP to reduce the landfill monitoring from annually to quarterly. The town needs to monitor consecutively for 5 years in order to qualify for the reduction in testing. The Board of Health has been waiting on CDM to start the process with the application to MA DEP. CDM has not assisted in the monitoring reduction request and did not conduct the quarterly testing as mandated by MA DEP. Deb will call MA DEP in order to determine what is needed to apply for this request.
MINUTES OF MEETING- It was moved by Elaine Byrne to approve the minutes for the September 16, 2014 meeting with the amendments; it was seconded by Alba Gouldthorpe and voted unanimously.

6:00 p.m.
